Terms of Service

1. Acceptance & who can agree
These Terms of Service (“Terms”) govern access to and use of the Wonderkit website and service at wonderkit.dev (the “Service”), operated by Mesmeraiz Inc, a Delaware C-Corporation (“Wonderkit,” “we,” “us,” or “our”).
Wonderkit is designed for use by children under the supervision and on the account of a parent or legal guardian. Only a parent or legal guardian who is at least 18 years old and legally able to enter into a binding contract may create a Wonderkit account and agree to these Terms, and they do so on their own behalf and on behalf of the children whose profiles they add to the account. Children do not, and cannot, agree to these Terms themselves.
By creating a Wonderkit account, adding a child profile, or otherwise accessing or using the Service, you represent that you meet these requirements and that you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
2. Accounts & eligibility
A Wonderkit account is created and held by a parent or guardian. The parent is the “account holder” for every child profile added to that account, and is responsible for all activity that occurs under the account, including activity by their child using a child profile within that account. Children do not have independent credentials and cannot create or access a Wonderkit account on their own.
Wonderkit is currently offered on an invite-only basis. Access may require an invitation or waitlist approval, and we may change, limit, or discontinue invite-only access at any time.
You are responsible for maintaining the confidentiality of your account credentials (including your sign-in email and any parent PIN you set up to gate parent-level views and actions) and for all activity that occurs under your account. Notify us promptly at privacy@wonderkit.dev if you believe your account has been accessed without authorization.
3. What Wonderkit is
Wonderkit lets a child describe an idea in their own words — a game, a story, a drawing, or another interactive creation — and uses artificial intelligence to help build a working version of that idea (a “creation”). Along the way, a child can chat with Wonderkit's guardian AI companion, which is designed to be encouraging, age-appropriate, and safety-aware.
Wonderkit is intended as a family creative tool for children to explore ideas and make things, under the supervision and account of a parent. It is not intended, and should not be relied on, as a general-purpose software development, hosting, or production platform.
4. Acceptable use / community rules
When using Wonderkit, you (and any child using your account) agree not to:
- Create, request, or attempt to create content that is hateful, sexually explicit, graphically violent, or otherwise harmful, dangerous, or inappropriate for a general audience of children.
- Attempt to disable, bypass, or circumvent Wonderkit's safety systems, content moderation, or the guardian AI's safety guardrails.
- Be disrespectful, harassing, bullying, or abusive toward Wonderkit staff, other users, or people described in chat or creations.
- Share personal information — your own or anyone else's — such as full names, home addresses, phone numbers, school names, photos of identifiable people, or other contact or location information, in chat messages or creations.
- Use the Service for any illegal purpose, or in violation of any applicable law or regulation.
- Attempt to reverse-engineer, scrape, overload, or otherwise interfere with the proper operation of the Service.
Because Wonderkit is used by children, the parent who holds the account is responsible for supervising their child's use of the Service and for helping their child understand and follow these community rules.
5. User content & creations
As between you and Wonderkit, your family owns the ideas, prompts, chat messages, and creations (“user content”) that a parent or child creates using the Service.
To operate the Service, you grant Wonderkit a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process (including by transmitting relevant content to our third-party AI providers so they can generate a chat response or a creation), display, and operate on your user content, solely as needed to provide, maintain, secure, and moderate the Service for you. This license also lets us moderate, flag, or take down content that violates these Terms or that we believe poses a safety risk.
Sharing a creation beyond your own family account — whether through a direct share link or Wonderkit's Community Feed — is off by default and is only turned on by an affirmative choice by the parent, for a specific creation or account-wide.
We work to keep your creations available, but we do not guarantee indefinite storage of any creation, chat transcript, or other user content, and we recommend not relying on Wonderkit as your family's sole copy of anything you want to keep permanently.
6. AI-generated content
Chat responses from the guardian AI and the creations built by Wonderkit's AI builder are generated using third-party artificial intelligence models (see our Privacy Policy for which providers we use). This AI-generated output is provided “as is,” without warranty of any kind.
AI-generated creations and chat responses may be inaccurate, incomplete, contain errors or bugs, behave unexpectedly, or fail to function as intended. Because AI models generate output based on patterns in a prompt, a similar idea or prompt entered by another family may result in a similar or substantially similar creation or response — Wonderkit does not guarantee that any creation is unique to your family.
Your family is responsible for reviewing, and for deciding how to use, rely on, or share, any creation or chat output generated through the Service. Wonderkit does not warrant that AI-generated creations are secure, error-free, or fit for any particular purpose, including if a creation is shared with or used by others.
7. Intellectual property
The Wonderkit name, logo, and other trademarks, and the Wonderkit software, website design, and underlying technology, are the property of Mesmeraiz Inc or its licensors and are protected by intellectual property laws. Nothing in these Terms grants you any right to use Wonderkit's trademarks or branding without our prior written permission.
As described in Section 5, your family retains ownership of the user content you create, subject to the license you grant us there to operate the Service.
8. Payments & subscriptions
Some Wonderkit features require a paid subscription plan. Payments and subscription billing are processed by Stripe, our payment processor, through Stripe's hosted Checkout and Customer Portal. We do not store your full payment card details ourselves; see our Privacy Policy for what billing metadata we retain.
Subscriptions renew on the billing cycle you select (e.g., monthly) until cancelled. You may cancel anytime through the Customer Portal or by contacting us; cancellation stops future billing but does not automatically entitle you to a refund for the current billing period.
Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods. You can cancel at any time to stop future charges, and your plan remains active through the end of the current billing period. Prices are exclusive of applicable taxes, which you are responsible for. If we change subscription prices, we will give existing subscribers at least 30 days' notice before the change takes effect.
9. Safety, moderation & termination
Wonderkit uses automated and human safety moderation to flag chat messages and creations that may violate Section 4 or otherwise raise a child-safety concern. Flagged content may be reviewed, restricted, or removed.
We may suspend or terminate an account, or restrict access to particular features, at any time and without advance notice, if we reasonably believe the account has violated these Terms, has been used in a way that endangers a child's safety, or otherwise poses a risk to Wonderkit, its users, or others. Where practical, we will try to notify the account's parent of the reason for the action.
If your account is terminated, your right to access the Service ends, and we may delete or retain your account's data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination (including Section 5, Section 6, Section 10, Section 11, and Section 12) will continue to apply.
10. Disclaimers & limitation of liability
THE SERVICE, INCLUDING ALL CHAT RESPONSES AND CREATIONS GENERATED BY OUR AI PROVIDERS, IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, AND WITHOUT ANY WARRANTY THAT AI-GENERATED CONTENT WILL BE ACCURATE, SAFE, SECURE, UNINTERRUPTED, OR ERROR-FREE.
Wonderkit's safety systems and guardian AI are designed to help reduce risk, but they are not a substitute for a parent's own judgment and supervision of their child's use of the Service. Parents remain responsible for supervising their child's use of Wonderkit.
To the maximum extent permitted by law, Wonderkit's total liability arising out of or relating to these Terms or the Service will not exceed the greater of the amount you paid to Wonderkit in the twelve months before the event giving rise to the claim, or US$100. To the maximum extent permitted by law, Wonderkit will not be liable for any indirect, incidental, special, consequential, or punitive damages.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or willful misconduct. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Mesmeraiz Inc from claims, damages, and expenses (including reasonable attorneys' fees) arising from your or your child's misuse of the Service, violation of these Terms, or violation of applicable law. This does not apply to claims arising from Wonderkit's own negligence or willful misconduct, or from the AI-generated content our Service produces.
12. Governing law & disputes
These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
Before filing a formal claim, we ask that you first contact us at privacy@wonderkit.dev so we can try to resolve the issue informally.
If we cannot resolve a dispute informally, it will be handled by the state or federal courts located in the State of Delaware, and you and Wonderkit consent to the personal jurisdiction and venue of those courts. These Terms do not require binding arbitration and do not waive your right to bring a claim in court. Nothing here limits any mandatory consumer protections available to you under the laws of your home state.
13. Changes to these terms
We may update these Terms from time to time. If we make a material change, we will notify parents (for example, by email or an in-app notice) before the change takes effect. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
